These Terms and Conditions constitute a legally binding contract between "Gharib Store" (referred to as the "Store" or "We") and the user of the website (referred to as the "Customer" or "You"). Your access to the Store, browsing it, or completing any purchasing transaction is considered an explicit acknowledgment and full agreement to all the provisions contained in this document, which is complementary to the policies of (Privacy, Shipping and Payment, and Exchange and Return).

1. General Obligations and Registration

• Eligibility for Use: The user must be at least 18 years old to complete purchasing transactions. The use of the site by minors must be under the supervision of legal guardians.
• Data Accuracy: The customer is obligated to provide correct, accurate, and up-to-date information upon registration or order completion (name, address, contact numbers). The customer bears full legal and financial responsibility for any delay or cancellation resulting from providing incorrect data.
• Account Confidentiality: The customer is entirely responsible for maintaining the confidentiality of their account data and password, and bears responsibility for all activities that occur under their account.

2. Orders and Pricing

• Product Availability: All orders are subject to the availability of products in stock. The Store reserves the right to notify the customer and cancel or modify the order in the event that the quantity runs out.
• Price Modification: We reserve the right to modify product prices or shipping costs at any time without prior notice. The approved prices at the exact moment of completing the actual order shall apply.
• The Store's Right to Cancel: The Store has the right, at its sole discretion, to reject or cancel any order in specific cases, such as: suspicion of fraudulent transactions, incorrect pricing of the product due to a technical glitch, or the customer's failure to respond to confirm the order.

3. Financial Transactions and Payment

• The customer is obligated to pay the order value through the approved electronic payment channels on the site (Mada, Credit Cards, Apple Pay, or installment services).
• All electronic payment transactions are considered final once they are accepted by the payment gateways.
• The "Cash on Delivery" service (if available) is subject to non-refundable administrative fees, and selecting it constitutes a commitment to pay the full amount to the shipping representative upon delivery.

4. Shipping and Delivery

• The Store is committed to handing over orders to shipping companies within the timeframes announced in the (Shipping Policy).
• Transfer of Risk: The responsibility for the product transfers to the customer as soon as they sign for the receipt of the shipment from the carrier company.
• In the event that the shipment cannot be delivered due to the customer's lack of response or provision of an incorrect address, the financial conditions outlined in the "Shipping Policy" shall apply, which includes charging the customer for return and reshipping fees.

5. Exchange, Return, and Warranty

• All product return operations are subject to the approved "Exchange and Return Policy" of the Store.
• The customer has the right to return within (3) days and exchange within (7) days from the date of receipt, provided that the product is in its original, unopened condition.
• The Store is not responsible for any damages resulting from the customer's misuse of the product, or failure to comply with the attached operating instructions.

6. Intellectual Property Rights

• All content displayed on "Gharib Store" (including texts, designs, logos, images, and software) is the exclusive property of the Store or its licensors, and is protected under intellectual property rights laws.
• It is strictly prohibited to copy, distribute, or commercially use any of the Store's content without prior written permission.

7. Limitation of Liability

• Under no circumstances shall "Gharib Store" bear responsibility for any indirect, incidental, or consequential damages arising from the use of the site, the inability to use it, or technical failures beyond our control.

8. Amendments and Applicable Law

• Updating Terms: The Store reserves the right to amend or update these Terms and Conditions at any time. The amendments become effective immediately upon being posted on the site, and your continued use of the Store constitutes agreement to them.
• Jurisdiction: These Terms and Conditions are governed by and construed in accordance with the regulations and laws applicable in the Kingdom of Saudi Arabia. In the event of any dispute arising, it shall be resolved amicably; otherwise, it shall be referred to the competent judicial authorities in the Kingdom.
